Confidential Advisor

Below is a description of the tasks and authorities of the confidential advisor:

The internal confidential advisor has the following tasks:

  1. Initial Reception and Advice: Provide initial reception and advice to a member of the club, their parents, or an employee of the club regarding abuse of power.

  2. Informing Parents: If a member of the club approaches the internal confidential advisor about abuse of power, the parents of the member must be informed unless there are significant reasons against it. This should preferably be done with the member's consent, especially if the member is older (> 12 years). From the age of 16, a member has the right to refuse permission to inform their parents.

  3. Referral: Refer as soon as possible to an external confidential advisor/agency, but only with the consent of the member (and their parents) and provide assistance in this process.

  4. Assistance with Complaints: Assist the member (and their parents) in submitting a complaint to the club's board, if desired.

  5. Monitoring: Observe, at the request of the external confidential advisor, whether submitting a complaint has negative consequences for the member, their parents, or others involved.

  6. Advisory Role: Contribute to improving the club's climate by providing solicited and unsolicited advice at the club level.

  7. Staying Informed: Stay informed about developments in the prevention and combat of abuse of power.

The internal confidential advisor is required to maintain confidentiality regarding information obtained in the course of their duties. This obligation does not apply to the competent authority in cases of suspected sexual harassment (reporting and disclosure obligation) and towards the member and their parents, the external confidential advisor, the complaints committee, judicial authorities, and doctors. The confidentiality obligation does not expire after the termination of the role as an internal confidential advisor.

The internal confidential advisor is solely accountable for their function to the competent authority. They cannot be dismissed, disciplined, or otherwise disadvantaged due to the exercise of their duties. They can be relieved of their duties if there is gross negligence or errors in their functioning as an internal confidential advisor.

The internal confidential advisor who wishes to terminate their duties must do so by written notification to the competent authority and ensure a proper transfer to their successor.

The board ensures accessible reachability and enables the internal confidential advisor to perform their duties adequately within the club's policy framework.

Liability / Damage: When the internal confidential advisor is active in their role, they are insured under the applicable regulations against legal liability through the collective liability insurance provided by the Royal Dutch Swimming Federation (KNZB) for members of clubs affiliated with the KNZB, including the swimming club Torpedo. Additionally, if someone suffers damage to body or property in the exercise of their function, this damage is fully compensated, considering the concepts of negligence/carelessness.
